Chapter I. General provisions


 
 

Article 1.1. Applicability


1.1.1.1. These regulations are pursuant to Article 102 of the Air Code of the Russian Federation, and to Russian and international legal documents pertaining to transportation by air.

1.1.1.2. These regulations apply to the domestic and international transportation by air of passengers, baggage and cargo by the carrier. The regulations establish the rights, obligations and responsibilities of the Carrier, and of the private citizens and cargo consignors and consignees using the carrier’s services.

1.1.1.3. The regulations apply to the international transportation by air of passengers, baggage and cargo if they do not contravene conventions on international transportation by air, International Civil Aviation Organization (ICAO) documents, or the Russian Federation's current international treaties and agreements on air traffic.

1.1.1.4. The regulations establish the general conditions of transportations of passengers, baggage and cargo, which must be observed when a contract of transportation by air of passengers, baggage and cargo is being concluded and when its conditions are being fulfilled.

1.1.1.5. When a contract of transportation by air of passengers, baggage and cargo is being concluded, the conditions, fares and charges that are in effect on the date the document of transportation is made out apply.

1.1.1.6. Questions arising when a flight is being sold, or during the procedures for registering documents of transportation, or boarding and disembarking (or loading and unloading), with regard to how these regulations, and other normative documents published in elaboration of them, apply to passengers and their baggage, or to consignors (or consignees), must be dealt with by officials working for the Carrier or its authorised agent.

 

Article 1.2. Relationship with the law


1.2.1. The parties' rights, obligations and responsibilities deriving from the contract of transportation by air of passengers, baggage and cargo, are regulated by:
  • conventions on international transportation by air, and the current international treaties and agreements to which the Russian Federation is a party;
  • the Air Code of the Russian Federation and other legislative acts of the Russian Federation;
  • these regulations.

1.2.2. The international transportation of passengers, baggage and cargo, is subject to the relevant mandatory decrees, regulations and prescriptions of the competent authorities of the country, into, out of or through the territory of which the journey is being made.

1.2.3. If any of the provisions specified in these regulations or in a document of transportation prove inconsistent with the legislation of a relevant country and cannot be altered by the agreement of the parties to the contract of transportation by air, such provisions shall remain in force and shall be considered part of the contract of transportation only to the extent that they are consistent with the legislation specified. The invalidity of any provision of these regulations does not, however, render the other provisions in them invalid.

1.2.4. In the case of transportation by air defined as international transportation by air, the Carrier's responsibilities are regulated by conventions on international transportation by air and by ICAO documents, unless these documents stipulate otherwise.

 

Article 1.3. Modifications to the regulations


1.3.1. These regulations, as well as any other rules, guidelines, instructions and documents regulating transportation by air published in elaboration of them, may be modified by the Carrier without giving passengers, cargo consignors and consignees prior notice. Modifications to these regulations are effective from the moment they are officially approved, but do not apply to transportation that has already commenced at the time. These regulations may be modified as a result of the requirements of current Russian law and international treaties and agreements on air traffic.

1.3.2. The Carrier's representatives and agents providing services connected to the transportation by air of passengers, baggage and cargo do not have the right to modify or waive the provisions of the conditions of transportation by air established by the Carrier.
