Chapter II. Regulations of the transportation by air of passengers, baggage and cargo


 
 

Article 2.1. The contract of transportation by air of passengers and cargo


2.1.1. The transportation by air of passengers, baggage and cargo is performed by the Carrier according with a contract of transportation by air and observance of these regulations.

2.1.2. Under a contract of transportation by air of a passenger, the Carrier is obliged to transport the passenger to his/her point of destination, to provide the passenger with a seat on board the aircraft operating the flight specified on the ticket and, in the case of the transportation by air of baggage, to deliver that baggage to the point of destination and to hand it over to the passenger or someone authorised by the latter to receive it. The time by which the Carrier should deliver the passenger and baggage to their destination is defined by the timetable established by the Carrier and these conditions. Passengers are obliged to pay for their transportation by air, as well as for that of any baggage they have that exceeds the free baggage allowance, and baggage subject to compulsory payment.

2.1.3. Under a contract of transportation by air of cargo, the Carrier is obliged to deliver the cargo entrusted to it by the consignor to its point of destination and to hand it over to the person authorised to receive it (the consignee), and the consignor is obliged to pay for the transportation by air of the cargo.

2.1.4. The document of transportation issued by the Carrier or its authorised agent is proof that a contract of transportation by air has been concluded between the Carrier and the passenger or consignor.

2.1.5. The transportation of passengers, baggage and cargo from an airport of departure to an airport of destination by several carriers under a single document of transportation (including any extra transport or payment documents issued with it) is considered a single act of transportation, whether or not any passenger or cargo transfer or break in transportation is involved.

 

Article 2.2. Documents of transportation


2.2.1. The document of transportation issued by the Carrier or its authorised agent is proof that a contract of transportation by air has been concluded between the Carrier and the passenger or consignor.

2.2.2. The documents of transportation are:
  • For transportation of a passenger and baggage: a passenger ticket and baggage check;
  • For transportation of baggage subject to additional payment: an excess baggage receipt;
  • For transport of cargo: an air waybill;
  • For payment by the passenger, consignor or consignee of charges and payments for services provided in connection with the fulfilment of the contract of transportation by air: a Miscellaneous Charges Order (MCO).

2.2.3. The documents of transportation specified in point 2.2.2 are high-security documents usable for financial accounting and verification in monetary and cashless transactions with passengers, consignors and between those involved in providing transportation.

 

Article 2.3. Scheduled and chartered transportation by air


2.3.1. The transportation by air of passengers, baggage and cargo between population centres (airports) on the flight route may be performed on a scheduled or non-scheduled (charter) basis.

2.3.2. Scheduled flights are operated in accordance with the published timetable.

2.3.3. The information on the passenger ticket and baggage check (or air waybill) must be consistent with the information published in the timetable when the said documents of transportation were made out.

2.3.4. The timetable may be altered by the Carrier without giving the passengers and consignor prior notice. The departure time stated on the ticket is not guaranteed and is not a condition of the contract of transportation by air.
The Carrier may cancel, postpone or delay the flight stated on a ticket or air waybill, may replace the aircraft and may alter the flight route, if the demands of flight and aviation safety require.

2.3.5. The Carrier is obliged to take all the measures depending on it to ensure that the carriage is performed on time, in accordance with the contract of transportation concluded.

2.3.6. Should it prove impossible to transport the passenger or cargo to the point of destination on the flight stated on the passenger ticket (or air waybill), the Carrier, with the approval of the passenger or consignor (or consignee), may:
  • transport the passenger or cargo to the point of destination stated in the document of transportation on another flight;
  • transfer the passenger or cargo to another Carrier for transportation;
  • organise transportation by another means of transport;
  • issue a refund according with the conditions of transportation by air established by the Carrier.

2.3.7. The Carrier is not liable for mistakes, aberrations or omissions in timetables published by other legal entities without the Carrier's approval.

2.3.8. Charter flights are operated according with pursuant to an aircraft charter contract concluded between the Carrier and the charterer. Under this contract, the Carrier is obliged to provide the charterer, in return for payment, with all or part of the space of one or more aircraft for the performance of one or more flights carrying passengers, baggage and cargo.

2.3.9. Charter flights are performed by the Carrier in accordance with a flight plan agreed in advance, with the conditions of transportation stipulated in the charter contract being observed.

2.3.10. The Carrier informs the passenger (or consignor) through the aircraft charterer of the conditions of the charter transportation and the need to observe the Carrier's conditions of transportation .

 

Article 2.4. The flight route, and changes to the flight route and the departure date and time


2.4.1. Passengers, baggage and cargo are transported between the population centres specified in the documents of transportation. The population centre (or centres) on the flight route specified in the documents of transportation may be changed by agreement between the Carrier and the passenger (or consignor).

2.4.2. If the Carrier cannot perform transportation between the population centres mentioned in the document of carriage, it must offer the passenger (or consignor) an alternative route. Should the passenger (or consignor) reject that alternative, the Carrier must reimburse the cost of the flight in accordance with these conditions.

2.4.3. If the passenger (or consignor) moves the date and/or time of transportation specified in the document of transportation forward or back, this is treated as a flight cancellation on the initiative of the passenger (or consignor), i.e., as a voluntary flight cancellation.

 

Article 2.5. Provision of services and information


2.5.1. The Carrier aims to provide passengers, consignors and consignees at airports, other ticket sale and check-in points, and on board the aircraft with first-rate services in connection with the provision and execution of transportation by air transport.
The services provided by the Carrier or its authorised agent are free or refundable.

2.5.2. At the airport, at no extra cost, the Carrier is obliged to:
  • check in passengers and handle baggage for the route and flight specified in the document of transportation, and maintain high standards of aviation safety of passengers, baggage and cargo;
  • convey departing (or arriving) passengers from the terminal building to the aircraft (or vice versa), board them onto the aircraft and disembark them from it on arrival at an airport of transit, transfer or destination;
  • convey baggage and cargo to the aircraft and back, load it onto the aircraft, and unload it from the aircraft;
  • run customs and border controls, plus, where necessary, sanitation/quarantine, visa, immigration, veterinary and phytosanitary controls, in the case of international transportation;
  • accommodate passengers with children the use of a room for mothers with children;
  • feed passengers if the flight is delayed by more than 4 hours through the fault of the Carrier;
  • accommodate passengers in a hotel if the flight is delayed by more than 6 hours through the fault of the Carrier;
  • transport passengers from the airport to the hotel and back in cases when it is providing free hotel accommodation.

2.5.3. At airports and points of ticket sale, the Carrier is obliged to provide the following information at no extra cost:
  • the times of departure and arrival (take-off and landing) for the flight according to the timetable (or flight plan);
  • the location and opening and closing times for the check-in of passengers and baggage for the flight specified in the document of transportation;
  • the boarding time for the flight in the timetable (or flight plan);
  • any delays to the flight in the timetable (or flight plan) and their causes;
  • the flight timetable, and the cost of carriage by air on the routes being operated, including concessions for children and other categories of passenger;
  • the conditions of transportationof passengers, baggage and cargo, including the free baggage allowance, the articles and materials prohibited on the flight, and other specific conditions of transportation;
  • the addresses of the points of sale and the rules for booking and purchasing flights;
  • the rules and procedures for passing through passenger, baggage and cargo airport security checks;
  • the rules for passing through customs and border controls and other administrative formalities on international flights;
  • the Carrier may provide passengers and consignors (or consignees) with other information in accordance with these regulations.

The Carrier is obliged to provide passengers accurate and timely information on aircraft movement and services provided.

2.5.4. Information on the details of the documents of transportation in the name of a specific passenger (or cargo), on check-in procedures at the airport of departure, and on take-off and landing, shall be provided only upon written requests from government bodies or enterprises, institutions and organisations, or private citizens, if such requests are considered justified.

2.5.5. The Carrier must distribute the following to airports and points of ticket sale:
  • a timetable of aircraft movements from the airport;
  • these regulations and the regulatory documents concerning the conditions of transportation of passengers, baggage and cargo;
  • information on the procedures for passing through security checks, on the articles and materials prohibited on air transport, and on liability for violation of these regulations;
  • information on the conditions of transportation of various categories of passenger, on the documents passengers need to present in order to travel on the aircraft, and on the free baggage allowance regulations according to the type of aircraft.

 

Article 2.6. Reservation of space on an aircraft


2.6.1. Reservation of space (passenger seat, tonnage or volume) on the Carrier's aircraft is for passengers and consignors a required condition of the transportation by air of passengers, baggage and cargo.

2.6.2. The space reservation is made by the Carrier or its authorised agent.

2.6.3. Space can be reserved both via a personal application to the Carrier from the passenger or consignor, or from an agent authorised by either, and by telephone, fax, e-mail, the internet or other form of communication.

2.6.4. A space reservation is valid only if it is entered into the Carrier's reservation system and made in accordance with the conditions established by the Carrier and does not contravene the conditions of the contract of transportation.

2.6.5. The possibility of modifying or cancelling the reservation of space on the aircraft may be limited or removed in accordance with the fare rules established by the Carrier.

2.6.6. When the deadline for saving the reservation in the reservation system expires, the booking is cancelled without prior notice..

2.6.7. When space is being reserved, the Carrier does not offer the passenger a specific seat in the cabin with a specific class of service. The passenger is told his/her seat number by the Carrier or its authorised agent at check-in at the point (airport) of departure.

2.6.8. When space is being reserved for the transfer of cargo, the Carrier or an agent authorised must obtain confirmation that space has been reserved for all segments of the journey, include those flown by other Carriers.

2.6.9. Passenger and consignor space must be reserved and the document of transportation of the transportation of passengers, baggage and cargo must be made out by the deadlines set by the Carrier's fare rules.

2.6.10. Passenger and consignor space reservations are considered provisional until the Carrier or a ticket sales agent authorised by it issues the passenger (or consignor) a completed document of transportation .

2.6.11. The Carrier has the right to annul a space reservation without notifying the passenger or consignor, if the passenger or consignor has not paid for the reservation by the deadline set or has not fulfilled other conditions established by the Carrier's fare rules.

2.6.12. In particular cases established by the Carrier's conditions of transportation by air, the Carrier has the right to request the passenger or consignor to confirm the space earlier allocated for him/her for the required route, the departure date and time, and the required class of on-board service.

 

Article 2.7. Information on passengers, baggage and cargo


2.7.1. When reserving space on an aircraft, passengers and consignors must inform the Carrier or its authorised ticket sales agent of the required flight route, departure date and time, number of seats and class of service, as well as, in the case of passengers, their nationality, plus any special conditions of transportation of them and their baggage, and, in the case of consignors, the name, weight and volume the cargo, plus any special features and conditions of transportation of the cargo.

2.7.2. Special conditions requiring the Carrier's approval apply when reserving space for the transportation of:
  • children under 12;
  • children unaccompanied by adults or guardians;
  • excess baggage;
  • outsized or heavy baggage/cargo;
  • sports equipment;
  • baggage/cargo that has to be transported in the cabin;
  • baggage/cargo that requires special conditions of transportation ;
  • animals or birds;
  • seriously ill persons or passengers on stretchers;
  • pregnant women;
  • passengers with vision (or hearing) loss, with or without accompaniment;
  • passengers with vision loss with a guide dog;
  • invalids in wheelchairs;
  • passengers with special dietary requirements;
  • passengers needing assistance from the Carrier;
  • passengers with a weapon and/or ammunition;
  • transit or transfer passengers without a visa.

2.7.3. The Carrier does not have the right to pass on information received from the passenger or consignor to third parties, with the exception of cases stipulated by current Russian law.

 

Article 2.8. Annulment of a reservation for a segment of a journey


The Carrier has the right to annul a space reservation for a leg of an outward or return journey if the passenger or consignor has not used the space reserved for him/her on one of the previous segments of the journey.

 

Article 2.9. Fares, taxes, charges and discounts


2.9.1. The air fare applies only to payment for the transportation of passengers, baggage and cargo from the point of departure to the point of destination and is set by the Carrier.

2.9.2. The fare applied must be current on the day transportation is commenced. Should there be a change in the fare or the exchange rate used, any passenger ticket, baggage check or air waybill paid for by the passenger (or consignor) and issued before the Carrier's announcement of it shall remain valid, and the passenger (or consignor) does not need to pay a surcharge, if no change has been made to the contract of transportation by air. No changes to the fares or the Carrier's fare rules affect the conditions of the contract of transportation by air if transportation has already commenced.

2.9.3. If a passenger voluntarily changes his/her itinerary after transportation is commenced, he/she shall be issued a new ticket at the fare corresponding to the new itinerary. The fare for the new route shall be recalculated from the starting point of the itinerary, at the rate in effect on the day transportation was commenced. The sum of the additional payment is calculated as the difference between the original fare and the fare for the new route, including all required charges. If the fare for the new itinerary is less than the original fare, the difference between them shall be entered into an MCO or refunding at the place where the original ticket was acquired.

2.9.4. The procedure for calculating the taxes and charges to be paid by the passenger is established by the relevant state authorities and/or by the Carrier and is told to the passenger at the point of sale when the document of transportation is being made out. Any tax or charge is paid by the passenger in addition to the fare, unless otherwise stipulated by the Carrier's fare rules.

2.9.5. Air fare discounts are established by the Carrier's fare rules, which are pursuant to current Russian law and the regulatory documents of the federal civil aviation authorities.

2.9.6. Fares, taxes and charges are paid by the passenger (or consignor) in the currency of the country in which the document of transportation is issued, or in another currency established by the Carrier, if this does not contravene the currency regulations of the country of sale.

2.9.7. If payment for the transportation is made in a currency other than the one in which the fare is published, the equivalent in the currency of payment shall be calculated on the basis of the exchange rate that is published in the reservation system and is in effect when the document of transportation is being made out. This notwithstanding, the amount of the equivalent fare payment shall be additionally regulated by the Carrier.
